The december 2006 finding of the ICJ in the Armed activities on the territory of the Congo Case that it has no jurisdiction, illustrates that the UN Charter should be amended in such a way that the ICJ has jurisdiction on the basis of Article 36.1 of its Statute in a situation in which violations of the general prohibition on the use of force, as embodied in Article 2.4 of the UN Charter, appear to have been committed. When the Security Council under Chapter VII of the Charter has determined that such a situation is the case, any State or the Security Council can refer such a situation to the Court.
